Mens rea es un término latino (que se puede traducir como "mente culpable") utilizado en el derecho penal. La prueba estandar en el derecho anglosajón para determinar la responsabilidad criminal se suele expresar con la frase latina, actus non facit reum nisi mens sit rea, la cual quiere decir "el acto no hace que la persona sea culpable a menos que la mente también sea culpable". En las jurisdicciones que contienen un debido proceso debe haber un actus reus acompañado con un nivel de mens rea para constituir el delito. La excepción son los delitos que prescinden de la intencionalidad del actor (en el derecho civil no es siempre necesario probar la mentalidad subjetiva de una persona para establecer responsabilidad, como en el incumplimiento de un contrato, aunque la intencionalidad puede ser una agravante para determinar indemnizaciones) Mens rea se refiere al estado mental de una persona al realizar un actus reus. En algunas jurisdiciones el término mens rea y el actus reus han sido suprimidos por una terminología alternativa. En Australia, por ejemplo, los elementos de todos los delitos federales son llamados "elementos de culpa" (Fault Elements - mens rea) y "elementos físicos" (Physical Elements - actus reus).
